The Situaton

• The organisation had received negative feedback following a recent regulatory visit
• As a result, it had been the subject of an FCA Section 166 review
• A Skilled Person was in the process of being appointed to lead the s.166


• The organisation had not centrally managed the initial response to the regulatory review
• As a result, the outcomes required to close the issues were unclear
• Some of the dates agreed to were unachievable
• There was a lack of overall control, governance and planning
• There was a risk of further disappointing the regulator and lengthening the duration of the s.166

How P2 FinCrime helped

• Supported the organisation throughout the review and selection of the Skilled Person
• Provided a central control point for the programme
• Acted as the control room for Information requests from and back out to the Skilled Person
• Gathered all regulatory issues from the review into a central repository
• Provided subject matter expertise around key issues to ensure the organisation was planning to align to industry best practice
• Worked with the Skilled Person to agree the outcomes required to close each issue
• Defined the evidence required to back issue closure
• Revisited the target dates and managed regulatory expectations around achievability
• Baselined the plan across all deliverables
• Worked with individual issue owners to agree outcomes and timelines
• Managed the day to day risks, issues and dependencies across the programme
• Built appropriate governance and reporting
• Supported the Risk Committee with evaluation of plans, deliverables and reports

The Outcome

• We were able to re-baseline the programme and meet the revised dates
• The organisation improved its underlying Fin Crime control framework
• Over the agreed timescale all issues were closed or mitigated to an acceptable level
• The Section 166 review was completed, and the Skilled Person oversight was ended
• The Fin Crime BAU capability was improved and a sustainable model was put in place for the future
• The organisation improved its relationship with the regulator based on achieving the goals that were agreed
